  2. Statement of Purpose
  3. The laws of most jurisdictions throughout the world automatically confer
  4. exclusive Copyright and Related Rights (defined below) upon the creator
  5. and subsequent owner(s) (each and all, an "owner") of an original work of
  6. authorship and/or a database (each, a "Work").
  7. Certain owners wish to permanently relinquish those rights to a Work for
  8. the purpose of contributing to a commons of creative, cultural and
  9. scientific works ("Commons") that the public can reliably and without fear
  10. of later claims of infringement build upon, modify, incorporate in other
  11. works, reuse and redistribute as freely as possible in any form whatsoever
  12. and for any purposes, including without limitation commercial purposes.
  13. These owners may contribute to the Commons to promote the ideal of a free
  14. culture and the further production of creative, cultural and scientific
  15. works, or to gain reputation or greater distribution for their Work in
  16. part through the use and efforts of others.
  17. For these and/or other purposes and motivations, and without any
  18. expectation of additional consideration or compensation, the person
  19. associating CC0 with a Work (the "Affirmer"), to the extent that he or she
  20. is an owner of Copyright and Related Rights in the Work, voluntarily
  21. elects to apply CC0 to the Work and publicly distribute the Work under its
  22. terms, with knowledge of his or her Copyright and Related Rights in the
  23. Work and the meaning and intended legal effect of CC0 on those rights.
  24. 1. Copyright and Related Rights. A Work made available under CC0 may be
  25. protected by copyright and related or neighboring rights ("Copyright and
  26. Related Rights"). Copyright and Related Rights include, but are not
  27. limited to, the following:
  28. i. the right to reproduce, adapt, distribute, perform, display,
  29. communicate, and translate a Work;
  30. ii. moral rights retained by the original author(s) and/or performer(s);
  31. iii. publicity and privacy rights pertaining to a person's image or
  32. likeness depicted in a Work;
  33. iv. rights protecting against unfair competition in regards to a Work,
  34. subject to the limitations in paragraph 4(a), below;
  35. v. rights protecting the extraction, dissemination, use and reuse of data
  36. in a Work;
  37. vi. database rights (such as those arising under Directive 96/9/EC of the
  38. European Parliament and of the Council of 11 March 1996 on the legal
  39. protection of databases, and under any national implementation
  40. thereof, including any amended or successor version of such
  41. directive); and
  42. vii. other similar, equivalent or corresponding rights throughout the
  43. world based on applicable law or treaty, and any national
  44. implementations thereof.
  45. 2. Waiver. To the greatest extent permitted by, but not in contravention
  46. of, applicable law, Affirmer hereby overtly, fully, permanently,
  47. irrevocably and unconditionally waives, abandons, and surrenders all of
  48. Affirmer's Copyright and Related Rights and associated claims and causes
  49. of action, whether now known or unknown (including existing as well as
  50. future claims and causes of action), in the Work (i) in all territories
  51. worldwide, (ii) for the maximum duration provided by applicable law or
  52. treaty (including future time extensions), (iii) in any current or future
  53. medium and for any number of copies, and (iv) for any purpose whatsoever,
  54. including without limitation commercial, advertising or promotional
  55. purposes (the "Waiver"). Affirmer makes the Waiver for the benefit of each
  56. member of the public at large and to the detriment of Affirmer's heirs and
  57. successors, fully intending that such Waiver shall not be subject to
  58. revocation, rescission, cancellation, termination, or any other legal or
  59. equitable action to disrupt the quiet enjoyment of the Work by the public
  60. as contemplated by Affirmer's express Statement of Purpose.
  61. 3. Public License Fallback. Should any part of the Waiver for any reason
  62. be judged legally invalid or ineffective under applicable law, then the
  63. Waiver shall be preserved to the maximum extent permitted taking into
  64. account Affirmer's express Statement of Purpose. In addition, to the
  65. extent the Waiver is so judged Affirmer hereby grants to each affected
  66. person a royalty-free, non transferable, non sublicensable, non exclusive,
  67. irrevocable and unconditional license to exercise Affirmer's Copyright and
  68. Related Rights in the Work (i) in all territories worldwide, (ii) for the
  69. maximum duration provided by applicable law or treaty (including future
  70. time extensions), (iii) in any current or future medium and for any number
  71. of copies, and (iv) for any purpose whatsoever, including without
  72. limitation commercial, advertising or promotional purposes (the
  73. "License"). The License shall be deemed effective as of the date CC0 was
  74. applied by Affirmer to the Work. Should any part of the License for any
  75. reason be judged legally invalid or ineffective under applicable law, such
  76. partial invalidity or ineffectiveness shall not invalidate the remainder
  77. of the License, and in such case Affirmer hereby affirms that he or she
  78. will not (i) exercise any of his or her remaining Copyright and Related
  79. Rights in the Work or (ii) assert any associated claims and causes of
  80. action with respect to the Work, in either case contrary to Affirmer's
  81. express Statement of Purpose.
  82. 4. Limitations and Disclaimers.
  83. a. No trademark or patent rights held by Affirmer are waived, abandoned,
  84. surrendered, licensed or otherwise affected by this document.
  85. b. Affirmer offers the Work as-is and makes no representations or
  86. warranties of any kind concerning the Work, express, implied,
  87. statutory or otherwise, including without limitation warranties of
  88. title, merchantability, fitness for a particular purpose, non
  89. infringement, or the absence of latent or other defects, accuracy, or
  90. the present or absence of errors, whether or not discoverable, all to
  91. the greatest extent permissible under applicable law.
  92. c. Affirmer disclaims responsibility for clearing rights of other persons
  93. that may apply to the Work or any use thereof, including without
  94. limitation any person's Copyright and Related Rights in the Work.
  95. Further, Affirmer disclaims responsibility for obtaining any necessary
  96. consents, permissions or other rights required for any use of the
  97. Work.
  98. d. Affirmer understands and acknowledges that Creative Commons is not a
  99. party to this document and has no duty or obligation with respect to
  100. this CC0 or use of the Work.
